NEPGA petitioned the U.S. Court of Appeals for the D.C. Circuit to hear its appeal of the orders in which FERC rejected NEPGA’s requests for relief from the Peak Energy Rent Adjustment (PER) mechanism.  NEPGA asks the Court to vacate the FERC orders rejecting NEPGA’s complaint on the PER mechanism, with instructions to establish a refund effective as of the date of the complaint (December 3, 2014), direct ISO-NE to review the PER mechanism for the FCA 5 – FCA 8 Capacity Commitment Periods, and grant any other relief it deems appropriate.
