NEPGA Answers Vineyard Wind Emergency Motion – On Tuesday, NEPGA filed an Answer to the Emergency Motion filed by Vineyard Wind on Monday (just hours before the commencement of FCA 13) in which Vineyard Wind asked FERC to stay, or in the alternative “re-run” FCA 13 following its conclusion (Docket No. ER19-570). Vineyard Wind’s request came following FERC’s failure to act on Vineyard Wind’s petition for a waiver of the ISO-NE Tariff to allow Vineyard Wind to participate as a Renewable Technology Resource (RTR) in FCA 13. In its waiver request, Vineyard Wind reported that in order for ISO-NE to offer Vineyard Wind as an RTR in FCA 13, FERC must have acted on the waiver request by January 29. When FERC failed to do so, ISO-NE reported on February 1 that it would not offer Vineyard Wind as an RTR. Vineyard Wind then followed with its Emergency Motion on Monday. FCA 13 did, in fact, run and conclude as scheduled, after which Commissioner’s LaFleur and Glick issued a joint statement, and Chairman Chatterjee issued a separate statement, each acknowledging that the Commission failed to act on Vineyard Wind’s waiver request due to it being deadlocked (with FERC a four-person commission at present). In its Answer, NEPGA highlights the potential harm to the market of allowing Vineyard Wind to participate as an RTR (which NEPGA challenged in answering Vineyard Wind’s waiver request) and of re-running an auction following its conclusion.
